USPTO database searched; no conflicting marks found. The trademark examining attorney searched the USPTO database of registered and pending marks and found no conflicting marks that would bar registration under Trademark Act Section 2(d). 15 U.S.C. §1052(d); TMEP §704.02.
Application has been amended as shown below. As agreed to by Geoffrey D. Aurini, Esq., on 06/18/20, the examining attorney has amended the application as shown below. Please notify the examining attorney immediately of any objections. TMEP §707. Otherwise, no response is required. Id. In addition, applicant is advised that amendments to the goods and/or services are permitted only if they clarify or limit them; amendments that add to or broaden the scope of the goods and/or services are not permitted. 37 C.F.R. §2.71(a).
The identification of goods is amended to read as follows:
“Radio machines and apparatus; radar machines and apparatus; telecommunication machines and apparatus, namely, vehicular radio communication machines and apparatus and vehicle safety equipment, namely, digital tachograph comprising of display monitors, computers, video cameras, and operating system and application software to detect vehicle location and vehicle safety equipment, namely, on-board cameras; electronic machines, apparatus and their parts, namely, Lidar apparatus, electronic control units and vehicle radar sensors for detecting light, distance, and images; Downloadable or recorded computer programs for processing information namely, people, vehicles and objects detected by radar or Lidar; measuring or testing machines and instruments; sensors and sensors for use in and with land vehicles” in International Class 9. See TMEP §§1402.01, 1402.01(e).
The identification of services is amended to read as follows:
“Computer software design, computer programming, or maintenance of computer software; technological advice relating to computers, automobiles and industrial machines; rental of computers; providing computer programming services for managing sensors and processing information namely, people, vehicles, and objects; rental of computer programs; cloud computing for managing sensors and processing information namely, people, vehicles and objects; hosting and rental of server memory space; providing non-downloadable software for use in managing sensors and processing information namely, people, vehicles, and objects” in International Class 42. See TMEP §§1402.01, 1402.01(e).
