DATABASE SEARCH:  The trademark examining attorney has searched the USPTO’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

APPLICATION HAS BEEN AMENDED:  In accordance with the authorization granted by Stephen Stark on April 26, 2016, the trademark examining attorney has amended the application as indicated below.  Please advise the undersigned immediately of any objections.  Otherwise, no response is necessary.  TMEP §707.  Any amendments to the identification of goods and/or services may clarify or limit the goods and/or services, but may not add to or broaden the scope of the goods and/or services.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq.

 

DESCRIPTION AND COLOR CLAIM

 

The examining attorney has amended the color claim and description to the following:  The color(s) red, white, black, dark blue, light blue and blue is/are claimed as a feature of the mark.  The mark consists of the term “TESINC LLC” in red with the term “TELECOM SERVICES” in black below.  A dark blue design of a curved line with a white curly line inside and a half circle next to it with white dots, all outlined in white appear to the left of the words.  A light blue wavy line appears out of the bottom of the “C” and goes to the end of the rectangle.  All of the wording and design is outlined in white appears on a blue background. 

 

STATEMENT OF DISCLAIMER

 

The examining attorney has added a statement to the application disclaiming the term “LLC” and “TELECOM SERVICES” in the mark.  The disclaimer states:

 

No claim is made to the exclusive right to use “LLC” and “TELECOM SERVICES” apart from the mark as shown.
