U.S.-LICENSED ATTORNEY REQUIRED
NEW DRAWING REQUIRED - DELETION OF TM SYMBOL
Applicant must submit a new drawing with the TM symbol deleted from the drawing of the mark; this symbol is not part of the mark and is not registrable. See 37 C.F.R. §2.72; TMEP §807.14(a). Although applicant must delete this matter, applicant may not make any other changes or amendments that would materially alter the drawing of the mark. See 37 C.F.R. §2.72; TMEP §§807.14 et seq. For more information about deleting matter from the drawing, see the Drawing webpage.
AMENDED DESCRIPTION OF THE MARK REQUIRED
Applicant must submit an amended description of the mark that agrees with the mark on the drawing. 37 C.F.R. §2.37; see TMEP §§808.01, 808.02. The current description is inconsistent with the mark on the drawing and thus is inaccurate. 37 C.F.R. §2.37; see TMEP §§808.01, 808.02. Descriptions must be accurate and identify only those literal and design elements appearing in the mark. See 37 C.F.R. §2.37; TMEP §§808.02, 808.03(d).
The following description is suggested, if accurate: The mark consists of the stylized wording "POLLITIN FLOWER POLLEN EXTRACT" where the wording "POLLITIN" is in a light green, green and dark green gradient and the wording "FLOWER POLLEN EXTRACT" is in black. The space within the letter "O" in the wording "POLLITIN" is represented by a white silhouette of flowers and grass. White also represents background and/or transparent areas.
Applicant must also address the following requirement.
AMENDED DISCLAIMER REQUIRED
Applicant must amend its voluntary disclaimer and disclaim the wording “FLOWER POLLEN EXTRACT” because it is merely descriptive of an ingredient of applicant’s goods. See 15 U.S.C. §§1052(e)(1), 1056(a); DuoProSS Meditech Corp. v. Inviro Med. Devices, Ltd., 695 F.3d 1247, 1251, 103 USPQ2d 1753, 1755 (Fed. Cir. 2012); TMEP §§1213, 1213.03(a).
Applicant may respond to this issue by submitting a disclaimer in the following format:
No claim is made to the exclusive right to use “FLOWER POLLEN EXTRACT” apart from the mark as shown.
For an overview of disclaimers and instructions on how to provide one using the Trademark Electronic Application System (TEAS), see the Disclaimer webpage.
Applicant must also address the following requirement.
EMAIL ADDRESS REQUIRED
Applicant must provide applicant’s email address, which is a requirement for a complete application. See 37 C.F.R. §2.32(a)(2); TMEP §803.05(b). This email address cannot be identical to the primary correspondence email address of a U.S.-licensed attorney retained to represent applicant in this application. See TMEP §803.05(b).
Applicant must also address the following requirement.
U.S.-LICENSED ATTORNEY REQUIRED
Applicant is required to be represented by a U.S.-licensed attorney to respond to or appeal the provisional refusal because applicant’s domicile is located outside of the United States and applicant does not appear to be represented by a qualified U.S. attorney. 37 C.F.R. §2.11(a); TMEP §601.01(a). An applicant whose domicile is located outside of the United States or its territories must be represented by an attorney who is an active member in good standing of the bar of the highest court of a U.S. state or territory. 37 C.F.R. §2.11(a); TMEP §§601, 601.01(a). In this case, applicant’s domicile is identified in the application as outside of the United States or its territories.
