INTRODUCTION

 

This Office action is in response to applicant’s communication filed on May 9, 2018.

 

In a previous Office action dated November 6, 2018, the applicant was required to satisfy the following requirements:  Identification Of Goods And Services; Description Of Mark & Color Claim Required.

 

Based on applicant’s response, the trademark examining attorney notes that the following requirement(s) have been satisfied: Description Of Mark & Color Claim Required.  See TMEP §§713.02, 714.04. 

 

Further, the trademark examining attorney maintains and now makes FINAL the requirement in the summary of issues below.  See 37 C.F.R. §2.63(b); TMEP §714.04.

 

SUMMARY OF ISSUES MADE FINAL that applicant must address:

 

PARTIAL REQUIREMENT: IDENTIFICATION OF GOODS

 

THIS PARTIAL REQUIREMENT APPLIES TO CLASS 7 ONLY

 

The wording below in the identification of goods in International Class 7 is indefinite and unclear.  This wording must be clarified because it is not clear whether certain entries are being limited by the wording that precedes it or if that wording is intended to be a separately listed good.  For example, it is not clear whether "motor and engine control devices, namely, hydraulic and pneumatic controls for motors and engines" is included in "electric motors and engines for operating blinds, screens, curtains, shutters, windows, ventilation hatches, locks, doors, garage doors, gates, barriers and grills."  Applicant may clarify these by entering semicolons between the distinct entries. 

 

In general, commas should be used in an identification (1) to separate a series of related items identified within a particular category of goods or services, (2) before and after “namely,” and (3) between each item in a list of goods or services following “namely” (e.g., personal care products, namely, body lotion, bar soap, shampoo).  Id.  Semicolons generally should be used to separate a series of distinct categories of goods or services within an international class (e.g., personal care products, namely, body lotion; deodorizers for pets; glass cleaners).  Id. 

 

In an application filed under Trademark Act Section 66(a), an applicant may not change the classification of goods and/or services from that assigned by the International Bureau of the World Intellectual Property Organization in the corresponding international registration.  37 C.F.R. §2.85(d); TMEP §§1401.03(d), 1904.02(b).  Therefore, although the goods and/or services may be classified in several international classes, any modification to this wording must identify goods in International Class 7 only, the class specified in the application for these goods.  See TMEP §1904.02(c), (c)(ii).

 

Applicant may adopt the following wording in International Class 7, if accurate: 

 

Class 7:           Motors and engines, namely, hydraulic and pneumatic motors and engines; electric motors and engines for operating blinds, screens, curtains, shutters, windows, ventilation hatches, locks, doors, garage doors, gates, barriers and grills; motor and engine control devices, namely, hydraulic and pneumatic controls for motors and engines

 

Applicant may amend the identification to clarify or limit the goods and/or services, but not to broaden or expand the goods and/or services beyond those in the original application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Generally, any deleted goods and/or services may not later be reinserted.  See TMEP §1402.07(e).  Additionally, for applications filed under Trademark Act Section 66(a), the scope of the identification for purposes of permissible amendments is limited by the international class assigned by the International Bureau of the World Intellectual Property Organization (International Bureau); and the classification of goods and/or services may not be changed from that assigned by the International Bureau.  37 C.F.R. §2.85(d); TMEP §§1401.03(d), 1904.02(b).  Further, in a multiple-class Section 66(a) application, classes may not be added or goods and/or services transferred from one existing class to another.  37 C.F.R. §2.85(d); TMEP §1401.03(d).

RESPONSE

 

Applicant must respond within six months of the date of issuance of this final Office action or the following class to which the final refusal(s) and/or requirement(s) apply will be deleted from the application by Examiner’s Amendment:  Class 7.  37 C.F.R. §2.65(a); see 15 U.S.C. §1062(b).

 

The application will then proceed for the following classes:  Classes 35 and 36. 

 

Applicant may respond by providing one or both of the following:

 

(1)       a response filed using the Trademark Electronic Application System (TEAS) that fully satisfies all outstanding requirements and/or resolves all outstanding refusals; and/or

 

(2)       an appeal to the Trademark Trial and Appeal Board filed using the Electronic System for Trademark Trials and Appeals (ESTTA) with the required filing fee of $200 per class.

In certain rare circumstances, an applicant may respond by filing a petition to the Director pursuant to 37 C.F.R. §2.63(b)(2) to review procedural issues.  TMEP §714.04; see 37 C.F.R. §2.146(b); TBMP §1201.05; TMEP §1704 (explaining petitionable matters).  There is a fee required for filing a petition.  37 C.F.R. §2.6(a)(15).
