The assigned examining attorney has reviewed the referenced application and determined the following.
The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. Section 1052(d). TMEP section 704.02.
The application lists the goods, “alarm clocks; belt buckles of precious metal (for clothing); bolo ties with precious metal tips; bracelets; busts of precious metal; candle snuffers of precious metal; candlesticks of precious metal; charms; clocks; earrings; jewelry; jewelry cases of precious metal; jewelry chains; key rings of precious metal; lapel pins; letter openers of precious metal; neck chains; necklaces; necktie fasteners; non-monetary coins; ornamental pins; pendants; rings; slides for bolo ties; stop watches; tie clips; tie fasteners; tie tacks; wall clocks; watch bands; watch cases; watch chains; watch straps; watches; wedding bands; wristwatches” in International Class 14.
The applicant must remove any parentheses from the identification of goods and incorporate the parenthetical information into the description. Generally, parentheses and brackets should not be used in identifications. TMEP §1402.12.
To follow is the examining attorney’s suggestion concerning the applicant’s identification of goods. The applicant may amend the application pursuant to the examining attorney’s suggestion, if accurate:
“Alarm clocks; belt buckles of precious metal for clothing; bolo ties with precious metal tips; bracelets; busts of precious metal; candle snuffers of precious metal; candlesticks of precious metal; charms; clocks; earrings; jewelry; jewelry cases of precious metal; jewelry chains; key rings of precious metal; lapel pins; letter openers of precious metal; neck chains; necklaces; necktie fasteners; non-monetary coins; ornamental pins; pendants; rings; slides for bolo ties; stop watches; tie clips; tie fasteners; tie tacks; wall clocks; watch bands; watch cases; watch chains; watch straps; watches; wedding bands; wristwatches” in International Class 14.
While an application may be amended to clarify or limit the identification of goods, additions to the identification are not permitted. 37 C.F.R. Section 2.71(b). TMEP section 1402.06. Therefore, the applicant may not amend to include any goods that are not within the scope of the present identification.
The applicant must clarify whether the name in or title the mark identifies a particular living individual.
If the name or title in the mark identifies a particular living individual, then applicant must submit the following:
(1) a signed, written consent from that individual, authorizing applicant to register the name as a trademark with the USPTO; and
(2) a statement that “Jack Sparrow identifies a living individual whose consent is of record.”
However, if the name or title in the mark does not identify a living individual, then applicant must submit a statement that “Jack Sparrow does not identify a living individual.” Trademark Act Section 2(c), 15 U.S.C. §1052(c); TMEP §§813 and 1206.
