Upon further review, the examining attorney has determined the following:
Registration Refused: 2(e)(1) Descriptiveness
The examining attorney refuses registration because the applied-for mark merely describes a feature of applicant’s goods. Trademark Act Section 2(e)(1), 15 U.S.C. §1052(e)(1); see TMEP §§1209.01(b), 1209.03 et seq.
In this instance, the applicant applied to register the mark ROYAL BLUE for “Men's, women's, Boy's, Girl's, Junior's pants, jeans, sweaters, jackets, shorts, knit/woven shirts.” Because Applicant's mark presumably describes a characteristic of the applicant’s goods (namely, the color), the examining attorney must refuse registration.
